Eurex Clearing AG is a company incorporated in Germany and licensed as a credit institution pursuant to the German Banking Act under supervision of the German Financial Supervisory Authority (BaFin – Bundesanstalt für Finanzdienstleistungsaufsicht).

Eurex Clearing AG has been granted authorization as a Central Counterparty (CCP) under the European Market Infrastructure Regulation (EMIR) on 10 April 2014. The authorization as EMIR compliant CCP also determines Eurex Clearing as a qualifying CCP (QCCP) under Basel III / CRD IV.

Eurex Clearing AG has been recognized as a foreign central counterparty by the Swiss Financial Market Supervisory Authority (FINMA). The FINMA issued the corresponding Order of Registration on 29 March 2018.

Eurex Clearing AG has been recognized by the Monetary Authority of Singapore (MAS) as a Recognised Clearing House (RCH). The MAS issued the corresponding Recognition on 14 September 2018.

The SINGAPORE ADDENDUM sets out the risk disclosure information required to be disclosed by Eurex Clearing AG pursuant to the conditions of recognition as a Recognised Clearing House by the Monetary Authority of Singapore.

Eurex Clearing AG has been recognized as a foreign financial instruments clearing organization by the Japanese Financial Services Agency (JFSA). The JFSA issued the corresponding Order of Registration on 12 March 2020.

Eurex Clearing has been approved to provide automated trading services (ATS) in Hong Kong by the Securities and Futures Commission (SFC). The SFC issued the corresponding Notice of Authorization under section 95(2) of the Securities and Futures Ordinance (SFO) on 7 September 2022.

Ontario

Date of Registration: 2017/07/14

Eurex Clearing AG has been granted an permanent exemption order under section 147 of the Securities Act (Ontario) (Act) exempting Eurex Clearing AG from the requirement in subsection 21.2(0.1) of the Act to be recognized as a clearing agency. The order has been issued on 14 July 2017 by the Ontario Securities Commission and expended on 6 February 2020.

Quebec

Eurex Clearing AG has been granted an exemption by the Authority of Financial Markets (AMF – Autorité des marchés financiers) under section 86 of the Derivatives Act, CQLR, c. I-14-01 (the QDA) from the requirement to be recognized as a clearing house pursuant to section 12 of the QDA and under section 263 of the Securities Act, CQLR, c. V-1.1 (the QSA) from the requirement to be recognized as a clearing house pursuant to section 169 of the QSA. The exemption order was issued on 20 June 2022.
